§ 1 General, Scope of the Terms and Conditions

1.1 All deliveries and services are provided exclusively on the basis of the following General Terms and Conditions (hereinafter referred to as “GTC”) in the version valid at the time of the order.

1.2 The contractual partner is [Perlenlicht, Kaiserpfalzstr. 85, Svetlana Eberhardt] (hereinafter referred to as “Seller”).

1.3 Customers within the meaning of these Terms and Conditions may be consumers (hereinafter "Customer"). Consumers within the meaning of these Terms and Conditions are natural persons who enter into contracts for a purpose that cannot be predominantly attributed to their commercial or professional activity.

§ 2 Conclusion of contract, formation of the contract

2.1 Our offer is binding. By placing your order, you accept our offer to conclude a contract. The contract is concluded when your order is sent to us. You will receive an order confirmation via email.

2.1 The offers and article presentations do not constitute a binding offer. Only your order is a binding offer after § 145 German Civil Code (BGB), which we can accept. After submitting your order, we will first send you an order confirmation by email. Upon acceptance of your order, you will receive an order confirmation by email within three business days of receiving your order, which will conclude the contract.

2.2 Once you have found the product you are looking for, you can view it in more detail without obligation by clicking on the product name or product image. You can add the item to your shopping cart by clicking the [Add to Cart] button. You can view the contents of your shopping cart at any time without obligation by clicking the [Shopping Cart] button. You can remove or edit products from your shopping cart by clicking on the [Change] and [Delete] icons. If you want to purchase the products in your shopping cart, click the [Checkout] button on the "Shopping Cart" page.

During the further ordering process, you will set up a customer account with us for your first purchase and select the shipping and payment method. In the final step, under "Order Information," you will see an overview of your order details. You can review all the information again and delete or change it under [Correct]. You can also correct input errors by navigating backward in your browser or canceling the ordering process and starting over. To complete the purchase, you must accept our terms and conditions and click the [Buy] button. This sends the order to us.

§ 3 Storage of the contract text

We save your order, the order data you entered, and the entire contract text. We will send you an order confirmation by email, followed by an order confirmation OR an order confirmation and order confirmation with all order data and the entire contract text.

§ 4 Right of withdrawal for consumers

The following right of withdrawal applies only to consumers in distance selling:

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.

To exercise your right of withdrawal, you must inform us (name, address and, if available, telephone number, fax number and email address) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form for this purpose, but this is not mandatory.

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.

Consequences of revocation

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

Contracts for the supply of goods which are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer cannot be revoked.

The right of withdrawal does not apply to the following contracts:

• Contracts for the supply of goods which can spoil quickly or whose expiry date would be quickly exceeded,

§ 5 Delivery conditions/shipping costs

1.Deliveries are generally only possible within Europe.

2. Delivery will take place within 5 working days, with working days being Monday to Friday, excluding public holidays. This period begins upon conclusion of the contract and may vary depending on the country and shipping method. § 6 Warranty

1. With regard to the warranty, the statutory provisions shall apply unless otherwise agreed in Section 7, paragraphs 2 to 3.

2. The warranty period shall be 24 months and shall commence upon delivery of the goods, provided that the customer is a consumer.

3. The warranty is excluded for defects caused by the customer. This particularly applies to improper handling, incorrect operation, or unauthorized repair attempts.

4. If goods are delivered with obvious transport damage, please report such defects immediately to the delivery person and contact us as soon as possible. Failure to file a complaint or contact us will not affect the statutory warranty claims of consumers and merely serves to assist the seller in asserting its claims against the company commissioned with delivering the goods or the insurance company.

§ 7 Payment

Payment can generally be made via PayPal, Sofortüberweisung, advance payment, credit card (Mastercard, VISA & Discover / Diners Club), paydirekt, or gift card. No discounts are available. We reserve the right to offer you only certain payment methods for the requested delivery, for example, to protect our credit risk, only those that correspond to your creditworthiness.

Payment via PayPal

You pay directly via your PayPal account. After submitting your order, you will be redirected to PayPal and authorize the order amount there. As soon as our PayPal account is notified of your authorization, shipping will occur – depending on the delivery time specified for the item. Your PayPal account will be charged immediately after authorization with the actual invoice amount, less any discounts, gift certificates, etc.

Payment by credit card

When paying by credit card, your credit card will be charged immediately after the order is completed. This happens immediately, even if we do not have the goods in stock and can only ship them in a few days. Our cooperation partner for this is Stripe payment service provider. Instant bank transfer

The purchase price will be debited from your account upon completion of the order.

Prepayment

Payment is made independently by the customer into Perlenlicht Shop’s bank account.

§ 8 Prices

Our prices are in euros and include VAT.

§ 9 Retention of title

The goods remain our property until full payment has been made.

§10 Right of set-off, right of retention

The customer is not entitled to offset our claims unless the customer's counterclaims have been legally established or are undisputed. The customer is also entitled to offset our claims if they assert complaints about defects or counterclaims arising from the same purchase contract.

§11 Severability Clause

Should any provision of these General Terms and Conditions be invalid, the validity of the remaining provisions shall not be affected.
